- You must only use the Website in accordance with these Terms and any applicable laws and must ensure that your employees, sub-contractors and any other agents who use or access the Website comply with the Terms and any applicable laws.
YOUR OBLIGATIONS
You must not:
- copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the Website without the express consent of Sysberg;
- forward link of resources to other contacts, via email or any other communication channels, provided to you as a result of your subscription;
- use the Website for any purpose other than the purposes of browsing, selecting or purchasing products and or services; and downloading resources if you are permitted to do so by Sysberg (e.g. via subscription)
- use, or attempt to use, the Website in a manner that is illegal or fraudulent or facilitates illegal or fraudulent activity; such as representing yourself as owner of any information or documents provided in the website ( e.g., forms, procedures, checklist, presentation, training videos etc.)
- use of other persons' works as a requirement for assignments, activities, and assessments for submission.
- use, or attempt to use, the Website in a manner that may interfere with, disrupt or create undue burden on the Website or the servers or networks that host the Website;
- use the Website with the assistance of any automated scripting tool or software;
- act in a way that may diminish or adversely impact the reputation of Sysberg, including by linking to the Website on any other website; and
- attempt to breach the security of the Website, or otherwise interfere with the normal functions of the Website, including by:
- gaining un-authorised access to Website accounts or data;
- scanning, probing or testing the Website for security vulnerabilities;

- instigate or participate in a denial-of-service attack against the Website
- where you have opted in to enroll in any of the Sysberg courses, you understand that a certificate of attainment will be issued to you only upon successful completion of the course.
By enrolling in this course, you agree to pay the full amount of the course fees, which are non-refundable, unless where required by applicable laws. There will be no refund in the following circumstances:
- you simply changed your mind or
- you are not able to complete the course due to poor performance or fail to meet the course requirements or
- after purchasing our product (course) or service, you were unclear about what you wanted.
You are required to pass the course in order to get the certificate for attainment. For a certificate of attendance- you are still required to complete the course and attempt the assignment (e.g. enrolment only or the halfway mark through the course will not be accepted).
INFORMATION ON THE WEBSITE
- While we make every effort to ensure that the information on the Website is as up-to-date and accurate as possible, you acknowledge and agree that we do not (to the maximum extent permitted by law) guarantee that:
- any prices displayed on the Website will be current or the same as any prices quoted to you in an order form for membership;

- the Website will be accessible at all times;
- bookings made through the website can be confirmed or met at all times
- messages sent through the Website will be delivered promptly, or delivered at all;
- information you receive or supply through the Website will be secure or confidential; or
- any information (including contents of course, blog, vlog) provided through the Website is accurate or true.
- you will get an intended outcome as a result of using our system, for example using resources, courses or any other materials or links that are available through our website.
We reserve the right
- to change any information or functionality on the Website by updating the Website at any time without notice, including product descriptions, prices and other Website Content.
- to take down the user-generated content if found to be illegal, obscene, infringing on others’ trademarks and copyrights or otherwise not in the strategic interest of Sysberg.
- to assess the risk to our business, review, filter and evaluate subscribers, members or customers and decide whether or not to grant our product, service or any other resources available through our Website.
- to monitor, investigate, and report any suspected or actual fraudulent activities to the appropriate authorities, and to take any legal action we deem necessary or appropriate.

Sysberg retains ownership of the Website and all materials on the Website (including course and blog contents, text, graphics, logos, design, icons, images, sound and video recordings, pricing, downloads and software), the Website Content and reserves all rights in any intellectual property rights owned or licensed by it not expressly granted to you.
You may make a temporary electronic copy of all or part of the Website for the sole purpose of viewing it. You must not otherwise reproduce, transmit, adapt, distribute, sell, modify or publish the Website or any Website Content without prior written consent from Sysberg or as permitted by law.
SECURITY
Sysberg does not accept responsibility for any kind of loss; or damage to computer systems, mobile phones or other electronic devices, arising in connection with the use of the Website. DISPUTE RESOLUTION

(Governing law) This agreement is governed by the law applying in New South Wales, Australia.
(Jurisdiction) Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales, Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with this agreement. Each party irrevocably waives any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum.
(Amendments) These Terms may only be amended by Sysberg in accordance with the Terms.
(Waiver) No party to these Terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.
(Further acts) Each party must promptly do all further acts and execute and deliver all further documents required by law or reasonably requested by another party to give effect to these Terms.
(Assignment) A party cannot assign, novate or otherwise transfer any of its rights or obligations under these Terms without the prior written consent of the other party.
(Entire Agreement) These Terms embody the entire agreement between the parties and supersede any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of the Terms.
